Culangex Terms of Service

The Services are intended for users of all ages, including children under 13 used in accordance with our Children's Privacy & Parental Consent Notice. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

If you create an account on behalf of a child, school, or organization, you represent that you have authority to bind that person or entity to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Subject to these Terms, Culangex grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and to install and run the game on devices you own or control, solely for your personal, non-commercial use (or, for institutional users, for the internal educational use authorized under a separate agreement).

This is a license, not a sale. We and our licensors retain all right, title, and interest in the Services.

You agree not to, and not to permit others to:

• Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Services except as expressly permitted.
• Reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law.
• Circumvent, disable, or interfere with security, digital rights management, or access controls.
• Use bots, scrapers, cheats, exploits, or automated means to access or manipulate the Services.
• Use the Services to develop a competing product, or to train machine-learning models on our content without our written permission.
• Upload or transmit malware, or interfere with the operation of the Services.
• Use the Services for any unlawful, infringing, harassing, or harmful purpose.
• Misrepresent your identity or impersonate others.

You agree to use the Services respectfully and lawfully. In any community, chat, multiplayer, or user-content features, you must not post or transmit content that is unlawful, harassing, hateful, threatening, sexually explicit, exploitative of minors, defamatory, or infringing. We may remove content and suspend or terminate accounts that violate these Terms, with or without notice.

Purchases may be processed through third-party storefronts and payment processors (for example, Steam). Your purchase is also subject to that platform's terms. Prices, content, and availability may change. Except as required by law or a platform's refund policy, all sales are final and fees are non-refundable. You are responsible for applicable taxes.

If you submit feedback, suggestions, recordings, or other content (“User Content”), you grant Culangex a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and create derivative works of that User Content to operate and improve the Services, subject to our Privacy Policy. You represent that you have the rights necessary to grant this license. Voice recordings used for pronunciation features are governed by our Privacy Policy, including the biometric and children's-privacy provisions, and are not used for advertising.

The Services, including all software, characters, worlds, narratives, artwork, audio, curriculum design, text, trademarks, and the names Culangex and Journey Within: Lexicons & Lore, are owned by Culangex or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers any ownership to you. All rights not expressly granted are reserved.

Our Services include language and cultural content developed with curriculum specialists, linguists, and cultural collaborators. We strive for accuracy and authenticity, but we make no representation or warranty that any linguistic, cultural, historical, or instructional content is complete, error-free, dialect-universal, or suitable for any particular certification, examination, or institutional requirement. Languages and cultures vary by region, community, and over time.

The Services are educational tools, not a guarantee of results. Culangex does not warrant or guarantee any specific learning outcome, level of language proficiency, test score, fluency, certification, academic credit, or accreditation. Learning outcomes depend on factors outside our control, including individual effort, prior knowledge, and frequency of use. The Services are not a substitute for accredited instruction where formal certification is required. Any references to curriculum frameworks (such as Backwards Planning or Universal Design for Learning) describe our design approach and do not constitute endorsement by, or compliance with the requirements of, any standards body, agency, or institution unless separately stated in a signed agreement.

The Services rely on third-party platforms and on AI and speech-processing technologies. AI-generated dialogue, feedback, translations, and pronunciation scoring may contain errors, inaccuracies, or unexpected output and should not be relied upon as authoritative. We are not responsible for third-party services, and your use of them may be governed by their own terms.

Some Services (including Early Access releases) are provided in a pre-release state, may be incomplete, may contain bugs, may change or be discontinued, and are provided strictly “as is.” Features, content, and availability during Early Access are not guaranteed to appear in any final release.

We may modify, suspend, or discontinue any part of the Services at any time. We may terminate or suspend your access for any violation of these Terms or for any lawful reason. Upon termination, the license in Section 2 ends. Sections that by their nature should survive (including Sections 6, 7, 9, 13, 14, 15, and 16) survive termination.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CULANGEX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACHIEVE ANY EDUCATIONAL RESULT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW:

• CULANGEX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR EDUCATIONAL OUTCOMES, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
• CULANGEX'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 100.00.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (INCLUDING, WHERE APPLICABLE, LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR HARM TO CONSUMERS THAT APPLICABLE LAW PROHIBITS LIMITING).

Please read this section carefully.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to Section 15, any permitted court action will be brought exclusively in the state or federal courts located in Harris County, Houston, Texas, and you consent to their jurisdiction. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

You agree to indemnify and hold harmless Culangex and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your User Content, or your violation of these Terms or applicable law. This indemnification does not apply to children to the extent prohibited by law.

We may update these Terms. We will post the updated version with a new “Last Updated” date, and material changes take effect upon posting or as otherwise required by law. Your continued use after changes means you accept them. Where required (including for children's data), we will seek renewed consent.

These Terms, the Privacy Policy, and any applicable institutional agreement are the entire agreement between you and Culangex regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
